            <description><![CDATA[<p>The Pittsburgh Steelers have had a tumultuous offseason with their quarterback Ben Roethlisberger and leading receiver Santonio Holmes both facing potential <strong><a href="http://www.muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html">criminal charges</a></strong>.&nbsp; A report has been leaked indicating that Roethlisberger will not be charged in connection with an alleged<strong> <a href="http://muscalaw.com/South_Florida_Criminal_Defense/Sex_Crimes.html">sexual assault</a> </strong>of a woman in a Georgia nightclub in early March.&nbsp; A decision is still pending on whether to charge Santonio Holmes for an alleged <a href="http://www.muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html"><strong>assault</strong> </a>in which he purportedly threw a glass at a woman in an Orlando nightclub.</p>
<p>The current incident was particularly troubling for Roethlisberger and those close to him because it was the second time he has faced allegations of sexual assault in less than a year.&nbsp; The case involving the Georgia woman arose as Roethlisberger faced a civil case filed last July by a woman who claims he raped her at a Lake Tahoe hotel and casino.&nbsp; Roethlisberger has not been criminally charged in either case and has claimed counter-damages in the lawsuit involving the Lake Tahoe incident.</p><object width="480" height="385"><embed height="385" type="application/x-shockwave-flash" width="480" src="http://www.youtube.com/v/k__dtkvVtP4&amp;hl=en_US&amp;fs=1&amp;" allowscriptaccess="always" allowfullscreen="true"></embed></object>
<p>According to allegations in the Orlando nightclub incident, the woman allegedly was seen going into the bathroom of the club but later contacted police and claimed that she had been sexually assaulted.&nbsp; While there had been no clear indication, there were certain aspects of the investigation that suggested Roethlisberger might not be charged including the woman missing police interviews and the fact that Roethlisberger was not interviewed nor was DNA evidence requested from Roethlisberger.&nbsp; An official announcement on whether Roethlisberger will be charged is expected any day.</p>

            <title>Florida Criminal Defense Attorney Musca Comments on Man Arrested for Shooting Dog </title>
            <description><![CDATA[<p>Ever since the Michael Vick dog fighting ring dominated the news, <a href="http://www.muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html"><strong>crimes committed against animals</strong> </a>particularly dogs have received a lot of coverage in the media.&nbsp; In a recent incident, a Tampa area man (Clearwater) is accused of shooting and killing his 9-year-old Chow dog.&nbsp; The police were summoned to the house of Yuriy Solovyev when neighbors called to report that they heard several gunshots.</p>
<p>When the police arrived at the scene, Solovyev was on the ground in his backyard with his dead Chow.&nbsp; The police investigated and discovered that Solovyev had an argument with his wife.&nbsp; His wife left the house following the fight.&nbsp; According to reports, Solovyev became extremely intoxicated before firing his gun multiple times.&nbsp; The police indicated that the dog had suffered several gunshot wounds and been killed.</p><object width="480" height="385"><embed height="385" type="application/x-shockwave-flash" width="480" src="http://www.youtube.com/v/UGX9vcUZIa4&amp;hl=en_US&amp;fs=1&amp;" allowfullscreen="true" allowscriptaccess="always"></embed></object>
<p>Officers indicated that the incident could have been much worse as one bullet ricocheted off the backyard fence and crashed through a neighbor's window.&nbsp; Although the bullet did not hit anyone, the report makes clear that someone in the neighbor's home could have been seriously injured or killed.&nbsp; The police report suggests that when the police arrived Solovyev was apparently in the process of burying the Chow.&nbsp; Solovyev appears to have passed out before he finished.</p>
<p>Solovyev was taken to the hospital for evaluation because of concerns regarding the high level of alcohol in his system.&nbsp; Solovyev faces charges of animal cruelty and discharging a firearm in public.&nbsp; He is being held at Pinellas County Jail in lieu of $5,150 bond. </p>

            <title>Florida Couple Charged with Stealing Medical Records for Personal Injury Cases </title>
            <description><![CDATA[<p style="MARGIN: 0in 0in 0pt" class="MsoBodyText2"><font color="#000000" size="3" face="Times New Roman">Ruben E. Rodriguez and Maria Victoria Suarez are under indictment for a second time for paying the employee of an ambulance company to provide information on patients transferred to hospital and medical clinics.<span style="mso-spacerun: yes">&nbsp; </span>The couple has allegedly been involved in the scheme since 1995.<span style="mso-spacerun: yes">&nbsp; </span>The couple faces two separate federal cases in which they are accused of <a href="http://muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html"><strong>selling medical records</strong> <strong>with patient contact and medical diagnosis information to personal injury lawyers</strong></a>.<span style="mso-spacerun: yes">&nbsp; </span>The couple was paid hundreds of thousands of dollars by attorneys who settled the cases.</font></p>
<p style="MARGIN: 0in 0in 0pt" class="MsoBodyText2"><font color="#000000" size="3" face="Times New Roman">In the prior case against the couple which is still pending, Rodriguez admitted to paying JMH ultrasound technician Rebecca Garcia $1000 per month for the medical records of hundreds of patients with various injuries resulting from slip-and-fall accidents, car-crash injuries, gunshot wounds and stabbings.<span style="mso-spacerun: yes">&nbsp; </span>Suarez was also an employee at JMH and helped set up the scheme.<span style="mso-spacerun: yes">&nbsp; </span>Garcia was convicted for her role in providing the medical records and was sentenced to a 10-month prison sentence.<span style="mso-spacerun: yes">&nbsp; </span>The patient records were then sold to personal injury lawyers who paid 35% of any recovery to Rodriguez and Suarez.<span style="mso-spacerun: yes">&nbsp; </span>One personal-injury lawyer allegedly wrote 27 checks totaling $85,250 to Rodriguez through a shell company.</font></p><object width="640" height="385"><embed height="385" type="application/x-shockwave-flash" width="640" src="http://www.youtube.com/v/S5tFeWobYg8&amp;hl=en_US&amp;fs=1&amp;" allowscriptaccess="always" allowfullscreen="true"></embed></object>
<p style="MARGIN: 0in 0in 0pt" class="MsoNormal"><font color="#000000" size="3" face="Times New Roman">The current indictment involves a very similar scheme wherein Rodriguez paid an employee of the ambulance company American Medical Response (AMR) and made several payments of $1000 to $2000 to the employee to supply the medical records.<span style="mso-spacerun: yes">&nbsp; </span>The couple then proceeded to sale the medical records to personal injury lawyers and health care clinics.<span style="mso-spacerun: yes">&nbsp; </span>"The alleged behavior is in violation of specific company policies and the employee was terminated," said a spokesman for AMR.</font></p>

            <title>Tampa Man Arrested for Murder in 1995 Cold Case </title>
            <description><![CDATA[<p>A man was arrested by a Tampa, Florida fugitive task force for<strong> <a href="http://muscalaw.com/South_Florida_Criminal_Defense/Violent_Crimes.html">murder</a></strong> in connection with a cold case dating back to 1995.&nbsp; Authorities are expected to charge John Earl Cantey with first-degree murder according to the Tampa Police Department.&nbsp; John Earl Cantey was arrested after new <a href="http://muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html"><strong>DNA evidence</strong> </a>was processed.&nbsp; Cantey was arrested on Tuesday, but the arrest was anticipated after Tampa police previously contacted Cantey to inform him that they were planning to arrest him based on the DNA results.</p>
<p>At the time of the original crime, Marsha Norris's body was discovered in an alley.&nbsp; Laboratory testing conducted in 2007 tied Cantey to the murder scene and Norris according to Tampa police.&nbsp; Norris was arrested by Tampa police after being interviewed by police and providing new DNA samples, which confirmed the evidence discovered in 2007.&nbsp; Tampa police also indicated that Cantey made incriminating statements that also played a role in his arrest.&nbsp; "We had been doing surveillance on him for sometime until the evidence came back that he was the one who committed the crime," said Tampa police spokesman Andrea Davis.</p><object width="480" height="385"><embed height="385" type="application/x-shockwave-flash" width="480" src="http://www.youtube.com/v/_FoodpX-7AM&amp;hl=en_US&amp;fs=1&amp;" allowscriptaccess="always" allowfullscreen="true"></embed></object>

            <title>Florida Criminal Defense Attorney on Teen Arrest for Videotaped Teen Assault </title>
            <description><![CDATA[<p>A student at South Dade Senior High School has been arrested and stands <strong><a href="http://www.muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html">accused of felony assault</a> </strong>under the Florida Criminal Code.&nbsp; A cell phone video shows a 16-year-old girl brutally beating Jertearia Walker.&nbsp; Walker's mother is questioning the apparent lack of security presence, which allowed the beating to continue for five minutes.&nbsp; A 24-second cell phone video shows the teenager beating Walker as other students watched and cheered.&nbsp; "They were rolling around the floor and stuff, and security didn't come for five minutes," said a student who witnessed the attack.</p><object width="425" height="344"><embed height="344" type="application/x-shockwave-flash" width="425" src="http://www.youtube.com/v/5ASQTK_Qb9c&amp;hl=en_US&amp;fs=1&amp;" allowscriptaccess="always" allowfullscreen="true"></embed></object>
<p>Walker's mother met with the school's principal to discuss why there were no adults or security to intervene and protect her daughter.&nbsp; She was not satisfied by the answers she received.&nbsp; "We have 3,360 students at the school and only 11 security, so I asked the principal, at that time, where was your security.&nbsp; And she doesn't know," said Walker's mom.<br />The school system's superintendent, Alberto Carvalho, said, "[W]e are venturing towards a quasi-legal determination of aggravated battery versus a simple fight."&nbsp; He distinguished the attack from a typical fight on campus where both parties face consequences because this was a "unilateral" attack where one party was obviously "the aggressor." Carvalho indicated one of the students was obviously the aggressor and the other a victim.&nbsp; Records show that the attack also was caught on school surveillance video.&nbsp; <strong><a href="http://www.muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html">Felony assault charges </a></strong>have been filed.</p>
<p>Assault and other forms of violence are a significant problem on Miami area school campuses.&nbsp; School records show 28 assault or battery incidents on the South Dade Campus.&nbsp; "My numbers are accurate," said Chief Charlie Hurley of Miami-Dade Schools Police.&nbsp; "It enables us to be able to decide strategically where to place our officers.&nbsp; How we assign our cops is one function of the data."&nbsp; </p>

            <title>Florida Criminal Defense Attorney Musca on Execution of Career Criminal and Pregnant Girlfriend </title>
            <description><![CDATA[<p>Police were still looking for career criminal John Lattimore when he and his girlfriend were gunned down in Fort Pierce.&nbsp; Lattimore, a Miami native, was found executed behind an abandoned house outside Fort Pierce.&nbsp; Lattimore's body was riddled with bullet holes.&nbsp; The body of Lattimore's girlfriend, Sharpkina Yolanda Woods, was discovered lying dead next to Lattimore.&nbsp; Children playing near an abandoned home outside Fort Pierce discovered the bodies.</p>
<p>Lattimore was considered a prime suspect in a February 8 shooting near Northwestern High School of Erick Johnson.&nbsp; Miami police had issued an <a href="http://www.muscalaw.com/South_Florida_Criminal_Defense/Criminal_Defense.html"><strong>arrest warrant</strong> </a>for him.&nbsp; Lattimore allegedly pulled out a chrome-plated handgun and shot Johnson in front of a grocery store.&nbsp; Lattimore fled the scene on a purple bike, which he abandoned outside a house near NW 14th Place and 71st Street.&nbsp; He reportedly sped away from that location in a green Ford F150 pickup.&nbsp;&nbsp; </p><object width="480" height="385"><embed height="385" type="application/x-shockwave-flash" width="480" src="http://www.youtube.com/v/Eiw9TZsRS5w&amp;hl=en_US&amp;fs=1&amp;" allowfullscreen="true" allowscriptaccess="always"></embed></object>

<p>Police believe that Lattimore and Woods were shot in a green 2004 Ford Expedition that belonged to Woods mother.&nbsp; The vehicle was discovered abandoned across town the morning the dead couple were discovered.&nbsp; An autopsy of Woods showed she was one month pregnant.</p>
