Our client was pulled over for speeding and for an expired tag. During the stop, it was determined that she did not have proof of insurance, had an expired tag, and was not wearing corrective lenses in violation of a restriction on her driver's license. She was cited for expired registration (a traffic citation) and violation of restriction on driver's license, under Florida Statute 322.16 (a criminal misdemeanor offense). She paid the traffic citation as it was the only way to immediately clear her driver's license and allow her to drive. However, the misdemeanor offense remained.
Our client had Lasik eye surgery in Columbia in 2007. Therefore, although her driver's license listed a restriction for corrective lenses, her vision was in fact already corrected. In order to validate the improvement in her vision, we instructed her to go down to the DMV and retake the eye test. She was issued a driver's license without the corrective lens restriction. We also had her produce a document from the surgeon in Columbia indicating that she underwent Lasik eye surgery and that her vision has been corrected.
At the non-jury trial, our attorney presented the assistant state attorney with the new driver's license (without a restriction for corrective lenses) and documentation of the Lasik eye surgery. Rather than fight it further, in light of this evidence, the assistant state attorney agreed to dismiss the charge (nolle prosse).
